Ethnographic notes:

  • This case, involving a New York City lawyer as the CHA, was widely circulated on news outlets and on social media. For one example, a comedian embedded the video within a larger response video, which was then reposted on a social media page with millions of subscribers. This is not an isolated incident for this CHA, who in fact has “a documented history of xenophobic and racist behavior,” which the media soon began to assemble after this case went viral (see sources below, which include additional video and photograph examples; see also CLDI_017). Some of the consequences in the aftermath of documenting these incidents include: (i) a petition calling for the CHA’s disbarment, (ii) termination of the lease where the CHA’s law firm held its physical operations, (iii) political officials sent a letter to the disciplinary committee that oversees New York state lawyers in order to file a formal complaint against the CHA, and (iv) protests outside the CHA’s home. The incident in this video takes place at a restaurant, where the CHA is speaking primarily to the manager of the restaurant (whom is not clearly hearable); however, other employees, as well as customers, are around and participate in the exchange. News articles report that the CHA said “give me my fucking sandwich” to an employee after hearing another customer order in Spanish, after which other employees and customers began to intervene. It is also reported that the manager ultimately asks the CHA to leave after the incident.

Transcript notes:

  • Video and transcript begin mid-altercation. We have used labels of target and bystander, but it is not clear who the initial/primary targets are, nor who is an employee vs. a customer, as several onlookers ultimately participate in various ways in this exchange. “ICE” (lines 41, 65-67), pronounced as ‘ice’, refers to “Immigration and Customs Enforcement”, the U.S. governmental office that prosecutes individuals residing in the country without documentation.
