Abstract

La vulgate juridique tient la généralité pour constitutive de la règle. Cette définition largement répétée et parfois critiquée fait référence aux propriétés formelles de la règle et non à la règle telle qu’elle se formule, se lit et s’applique dans la concrétude de ses pratiques. L’article entend opérer cette « respécification » de la question de la règle, en partant de ses constituants conceptuels, pour saisir la relation de référence et d’usage que ceux qui l’invoquent peuvent en avoir en situation. Le général et le particulier se transforment dès lors en catégories du raisonnement pratique, c’est-à-dire en accomplissements de ceux et celles qui recourent à la règle dans le fil de leurs actions publiques, politiques ou judiciaires. Pour traiter le rapport du particulier au général dans la pratique du droit, l’article portera tout d’abord sur la conception de la règle et sur son caractère général et abstrait dans la doctrine et la théorie du droit. Il reprendra ensuite la question dans la perspective des praticiens et usagers du droit. Il étudiera enfin l’affaire dite du « burkini » pour examiner comment la question se déploie, de manière contingente, à un triple niveau : celui de l’« opinion », celui de l’autorité réglementaire et celui de l’autorité qui juge.

The general and the particular. Analytical and praxeological perspective on the legal rule

The legal vulgate holds generality as constitutive of the rule. This widely repeated and sometimes criticized definition refers to the formal properties of the rule and not to the rule as it is formulated, read and applied in the concreteness of its practices. The article intends to operate this “re-specification” of the question of the rule, starting from its conceptual constituents, to grasp the relation of reference and use that those who invoke it can have in context. The general and the particular are therefore transformed into categories of practical reasoning, that is, into the achievements of those who resort to the rule in the course of their public, political or judicial actions. In order to deal with the relation of the particular to the general in the practice of law, the article will, first of all, deal with the conception of the rule and its general and abstract character in the doctrine and theory of law. It will then take up the issue from the perspective of practitioners and users of the law. Finally, it will study the so-called “burkini” case to examine how the issue is deployed, in a contingent manner, on a three-tiered level: that of “opinion”, that of the administrative authority, and that of the authority that judges.
